Welcome to Inphax. The words "we", "us" and "our" refer to Inphax. We operate this store and website, including all related information, content, features, tools, products and services (the "Services"). Inphax is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when using the Services. By visiting or using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Services.

1 · Access and eligibility

By agreeing to these Terms, you confirm that you are at least the age of majority in your state or country of residence. You are responsible for keeping your account credentials secure and for all activity on your account. You may not transfer or sell your account to anyone else.

2 · Our products

We make every effort to display our products accurately. Because our pieces are made from natural wood and ceramic, the grain, colour and finish of the item you receive will vary from the photographs. This is a characteristic of the materials, not a defect.

Colours may also appear differently depending on your screen. Product descriptions and availability may change at any time without notice, and we may discontinue any product or limit quantities at our discretion.

3 · Orders

When you place an order you are making an offer to purchase. We reserve the right to accept or decline any order. Your order is not accepted until we confirm it and your payment has been processed. Please review your order carefully before submitting it, as we may not be able to cancel it once it has been dispatched.

If we decline, change or cancel an order, we will contact you using the email address provided at checkout.

4 · Pricing and payment

All prices are shown in US dollars. Prices, discounts and promotions may change without notice. The price charged will be the price displayed at the time your order is placed and confirmed in your order confirmation email.

Unless stated otherwise, prices do not include any taxes, customs charges or import duties that may apply.

You confirm that the payment information you provide is accurate, that you are authorised to use the payment method, and that you will pay the amounts charged.

5 · Shipping and delivery

Shipping is governed by our Shipping Policy. All delivery times are estimates and are not guaranteed. We are not responsible for delays caused by the carrier, by customs processing, or by events outside our control. Once we transfer a product to the carrier, title and risk of loss pass to you.

6 · Returns

Returns and refunds are governed by our Refund Policy.

7 · Intellectual property

The Services, including all text, images, graphics, product photography, video, design and their selection and arrangement, are owned by Inphax or its licensors and are protected by copyright and other intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You may not reproduce, distribute, modify, republish or transmit any material from the Services without our prior written consent.

The name Inphax and our logo are our trademarks. You may not use them without our prior written permission.

8 · Customer reviews and feedback

If you submit a review, suggestion or any other content, you grant us a perpetual, worldwide, royalty-free licence to use, reproduce, modify and display it in any medium, including for commercial purposes.

You confirm that any content you submit is your own, does not infringe anyone else's rights, and is not unlawful, abusive or misleading. We may, but are not obliged to, monitor, edit or remove content at our discretion.

9 · Third-party links

The Services may contain links to websites operated by third parties. We are not responsible for the content, accuracy or privacy practices of those sites. If you choose to visit them, you do so at your own risk.

10 · Relationship with Shopify

Inphax is powered by Shopify, which enables us to provide the Services to you. All sales and purchases you make are made directly with Inphax. Shopify is not responsible for any aspect of the transaction between you and us, and you release Shopify and its affiliates from any claims arising out of your purchase.

11 · Errors and omissions

Occasionally there may be information on the Services containing typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times or availability. We reserve the right to correct any error and to change or cancel an order if any information is incorrect, at any time and without prior notice, including after the order has been submitted.

12 · Prohibited uses

You may use the Services only for lawful purposes. You may not use them for any unlawful or malicious purpose, to infringe our intellectual property or that of anyone else, to harass or abuse any person, to transmit false or misleading information, to send unsolicited advertising, to impersonate another person or entity, to upload malicious code, to scrape or harvest data, or to interfere with the security of the Services.

We may suspend or terminate your access at any time if we determine that you have breached these Terms.

13 · Disclaimer of warranties

Except as expressly stated by us, the Services and all products offered through them are provided "as is" and "as available", without any representation, warranty or condition of any kind, express or implied. We do not warrant that your use of the Services will be uninterrupted, timely, secure or error-free.

To the maximum extent permitted by law, Inphax and its officers, employees, affiliates, agents and service providers will not be liable for any indirect, incidental, punitive, special or consequential damages of any kind, including lost profits, lost revenue or lost data, arising out of your use of the Services or of any product purchased through them.

Where liability cannot be excluded, our total liability to you is limited to the amount you paid for the product giving rise to the claim.

You agree to indemnify and hold harmless Inphax and Shopify, and our respective affiliates, officers, employees and service providers, from any claims, damages or liabilities, including reasonable legal fees, arising out of your breach of these Terms, your violation of any law or third-party right, or your use of the Services.

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be severed and the remaining provisions will continue in full force.

These Terms, together with the policies referenced in them, constitute the entire agreement between you and Inphax and govern your use of the Services, superseding any prior agreements or communications.

You may not transfer or assign these Terms or any of your rights under them without our prior written consent. We may transfer or assign them without your consent.

19 · Governing law

These Terms are governed by the laws of the jurisdiction in which Inphax is established, and you agree to the jurisdiction of its courts.

20 · Changes to these Terms

You can review the most current version of these Terms at any time on this page. We reserve the right to update or replace any part of them by posting the revised version on our website. Your continued use of the Services after changes are posted constitutes acceptance of those changes.
